Terms and Conditions
1. Definitions
For the purpose of these Terms and Conditions:
Service Provider: Marissa Klouwer, operating under the name MarissaKlouwer and/or any affiliated entities.
Participant / Client: any natural or legal person making use of the Services provided by the Service Provider.
Services: all sessions, programs, trainings, trajectories, events, masterclasses, workbooks and digital products offered by the Service Provider.
2. Applicability
These Terms and Conditions apply to all offers, agreements and deliveries of Services by the Service Provider.
Deviations from these Terms and Conditions are only valid if agreed upon in writing.
3. Nature of the Services
The Services provided are focused on personal development, awareness, leadership and self-reflection.
The Services do not constitute medical, psychological, therapeutic, financial or legal advice and are not a substitute for professional treatment or counseling.
4. Personal Responsibility
Participation in sessions, programs and the use of workbooks is entirely at the Participant’s own risk and responsibility.
The Participant remains fully responsible for:
interpretation and application of all information and exercises
all personal decisions, actions and choices
any physical, emotional, mental, relational or business consequences
5. Liability
The Service Provider shall not be liable for any direct or indirect damage, consequential loss, immaterial damage or other adverse consequences arising from or related to:
participation in the Services
the use of workbooks or digital materials
the application of insights, exercises or guidance
To the extent that liability cannot be excluded by law, such liability shall be limited to the amount paid by the Participant for the relevant Service, or the amount paid out by the Service Provider’s liability insurance, whichever is lower.
6. Payment and Refunds
All payments for sessions, programs, trajectories and digital products are final and non-refundable.
No refunds will be issued under any circumstances, including but not limited to:
early termination
non-participation
personal circumstances
dissatisfaction with results
7. Rescheduling, Cancellation and Missed Sessions
Sessions and appointments are scheduled exclusively for the Participant.
Rescheduling or cancellation is only possible up to 48 hours prior to the scheduled session, and must be communicated in writing or by email.
Any cancellation or rescheduling within 48 hours prior to the session, as well as failure to attend a session (no-show), will be considered a late cancellation.
In case of late cancellation or no-show:
the session will be forfeited
there will be no right to rescheduling, replacement or refund
8. Results
The Service Provider makes no guarantees regarding specific results or outcomes.
Results depend on the Participant’s personal effort, circumstances and choices and may vary per individual.
9. Intellectual Property
All materials, workbooks, texts and content remain the intellectual property of the Service Provider.
These materials may not be copied, distributed or used for commercial purposes without prior written consent.
10. Governing Law and Jurisdiction
These Terms and Conditions are governed by Dutch law.
Any disputes shall be submitted exclusively to the competent court in the Netherlands.
11. Acceptance
By participating in a session or program, or by purchasing any product, the Participant confirms that they have read, understood and fully accepted these Terms and Conditions.
